General Terms and Conditions (GTC)
Hand Analysis Association HAFV
1. Scope
These General Terms and Conditions ("GTC") apply to the business activities of the Hand Analysis Association HAFV (hereinafter referred to as the "Hand Analysis Association"). The Hand Analysis Association owns and operates the platform www.handanalyse-fachverband.com and provides both paid and free services to its members, interested parties, and supporters. These GTC apply to the aforementioned areas as well as to other services provided directly and indirectly by the Hand Analysis Association to its members.

2. Membership
Membership is established through an approved admission process and the payment of an admission fee. Only students, practitioners, or former practitioners of hand analysis are eligible to become members.

3. Fees / Membership Contribution
The membership fee for active and passive members is determined by the general meeting.
4. Payment
Members are obligated to pay the invoiced amount within 30 days of the invoice date. The invoice will be sent via email. If the invoice is not paid within the specified payment period, the member will be reminded. Two payment reminders will be sent. If the member does not pay the invoice within the set reminder periods, they will be excluded from membership.

5. Obligations of the Hand Analysis Association
Unless otherwise agreed, the Hand Analysis Association fulfills its obligations by providing the agreed service. The service includes the services that were published online at the time of the contract conclusion.
6. Logo
6.1. Usage
The Hand Analysis Association grants only its members the right to use the logo for their printed materials or publications on their websites. Any transfer to third parties or other uses of a commercial or different nature is prohibited.
6.2. Formatting
It is not permitted to customize or alter the logo to meet personal needs. If the logo is created in a format that restricts the member's usage rights, this corresponds to the will of the Hand Analysis Association, and reformatting is not allowed.
6.3. Duration
Upon leaving the Hand Analysis Association, it is not permitted to continue using the logo.
7. Membership
7.1. Exercising Usage Rights
Members commit to representing the membership seriously in public. Members are fully responsible for the secure storage of their login credentials and passwords. The Hand Analysis Association takes limited responsibility for the content in the member directory. Generally, the member is responsible for this. The Hand Analysis Association reserves the right to monitor the content and delete any content that is not in accordance with the association's policies.
By accepting these GTC, the member also confirms that they have full legal capacity and are of legal age.
Applicants explicitly declare during registration that all provided information is truthful, current, and in compliance with the rights of third parties, good morals, and the law.
7.2. General Meeting
Current members participate in the general meeting. The Hand Analysis Association will send invitations in due time. Members of the Hand Analysis Association have the opportunity to submit motions to the board at any time and to make suggestions for the improvement of the professional association.
7.3. Other Obligations
The Hand Analysis Association has the right to monitor members' behavior in connection with the use of the member forum. The association, in particular, has the right to review the legality of content entered by members on the online platform at any time.
8. Withdrawal
Both parties have the right to reject or terminate a membership at any time.
9. Upgrade / Downgrade
Membership can be changed from active to passive or from passive to active at any time. However, the membership fee remains due as described in point 8.1.
10. Warranty
The Hand Analysis Association strives to ensure good availability of www.handanalyse-fachverband.com and takes reasonable precautions to protect the website from third-party interference.
However, the Hand Analysis Association cannot guarantee uninterrupted and error-free operation of www.handanalyse-fachverband.com and the services offered, nor can it guarantee that files are virus-free.
The Hand Analysis Association does not guarantee the factual and content accuracy, completeness, reliability, or quality of the published or transmitted information and documents.
Additionally, the Hand Analysis Association cannot guarantee protection against spamming, harmful software, spyware, hacker attacks, phishing, etc., that may affect the use of the service, damage the customer's infrastructure (e.g., devices, PCs), or otherwise harm them.
The Hand Analysis Association does not guarantee the factual and content accuracy, completeness, reliability, or quality of the provided, published, or transmitted information and processes as well as the work results of the services. Any issues or defects should be reported to the association immediately.
11. Liability
The Hand Analysis Association disclaims all liability for any business or personal disadvantages that arise from entries on www.handanalyse-fachverband.com. Any misconduct by the Hand Analysis Association is excluded.
12. Intellectual Property Rights
All rights to the published texts by members are copyright protected and may not be copied or used in any other way. The Hand Analysis Association reserves the right to take legal action against such violations. Furthermore, any further use, publication, and disclosure of information, images, texts, or other materials that members receive in connection with these provisions is prohibited unless explicitly authorized by the Hand Analysis Association. If members use content, texts, or visual material in connection with the Hand Analysis Association that is subject to third-party rights, members must ensure that no third-party rights are violated.
13. Data Protection
The Hand Analysis Association may process and use the data collected during membership to fulfill its services. The Hand Analysis Association takes the necessary measures to secure the data in accordance with legal requirements. Members fully agree to the storage and contractual use of their data by the Hand Analysis Association and are aware that the Hand Analysis Association is obligated and entitled to disclose member information upon order by courts or authorities.
Furthermore, the data protection provisions apply.
14. Amendments
These General Terms and Conditions may be changed by the Hand Analysis Association at any time. The new version takes effect upon publication on the website of the Hand Analysis Association. For members, the version of the GTC that was in effect at the time of the contract conclusion generally applies unless the member has agreed to a newer version of the GTC.

15. Applicable Law / Jurisdiction
These GTC are subject to Swiss law. Unless mandatory legal provisions take precedence, the court at the Hand Analysis Association's registered office has jurisdiction.
